TERMS OF USE

AGREEMENT TO TERMS​

 

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Hitmaker Kids (“Company”, “we”, “us”, or “our”), concerning your access to and use of the https://www.hitmakerkids.com/ website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use.​​

PROGRAM PURPOSE AND AGE ELIGIBILITY​

 

Hitmaker Kids is a music education and songwriting program designed specifically for children and teens ages 10–15.

​

Because our services are intended for minors, special rules apply:

​

1. Parent or Guardian Enrollment Required

All registrations, purchases, and submissions must be completed by a parent or legal guardian.

​

Children may not independently create accounts or submit personal information through the Site.

​

2. Users Under Age 13

Students under 13 may participate only with verifiable parental consent, in compliance with the Children’s Online Privacy Protection Act (COPPA).

​

3. Supervision Responsibility

Parents/guardians are responsible for supervising their child’s participation in all online activities, sessions, and submissions.

​

4. Parent Agreement

By enrolling a child, the parent or legal guardian agrees to these Terms on behalf of the minor participant.

 

INTELLECTUAL PROPERTY RIGHTS​

 

Unless otherwise indicated, the Site and all content, including designs, text, graphics, audio, video, logos, trademarks, and program materials (collectively, the “Content”) are owned or licensed by Hitmaker Kids.

The Content is provided for personal, educational use only.

​

No part of the Site or Content may be copied, reproduced, distributed, sold, or exploited for commercial purposes without our written permission.

 

USER REPRESENTATIONS

 

By using the Site, you represent and warrant that:

  1. All enrollment information submitted is accurate and complete

  2. You are at least 18 years old, or you are a parent/legal guardian enrolling a minor

  3. You consent to the collection of your child’s information for program participation

  4. You will comply with all applicable laws related to minors

  5. You will not use the Site for unlawful purposes

  6. Your use will not violate any regulation or third-party rights

 

We reserve the right to suspend or terminate access if information is false or misleading.

 

USER REGISTRATION

 

Parents or guardians may be required to register for an account.

You agree to keep login credentials confidential and accept responsibility for all activity under your account.

​

We reserve the right to remove or reclaim usernames deemed inappropriate.

 

MANDATORY AUDITIONS AND SKILLS SUBMISSIONS

 

Participation in Hitmaker Kids programs requires that all students complete an audition or skills submission as part of the enrollment and placement process.

​

Auditions are mandatory and non-negotiable. Students may not participate in the program without submitting the required audition materials.

​

Auditions may include, but are not limited to:

  • Singing recordings

  • Video performances

  • Songwriting samples or lyrics

  • Other music-related creative assignments

Parent/Guardian Consent Required

All audition submissions must be provided, completed, or expressly approved by a parent or legal guardian.

For students under the age of 13, this requirement applies in accordance with the Children’s Online Privacy Protection Act (COPPA).

​

Use of Audition Materials

Audition materials are collected and used solely for the purpose of:

  • Evaluating student eligibility

  • Determining appropriate placement within the program

  • Providing educational feedback

  • Ensuring a safe and suitable learning experience

 

Audition submissions are treated as confidential educational materials and will not be publicly shared without separate written parental permission through a Media Release Agreement.

No Guarantee of Acceptance

Submission of an audition does not guarantee admission. Hitmaker Kids reserves the right, in its sole discretion, to accept, reject, or place students based on suitability, educational needs, and program capacity.

Deletion Requests

Parents or guardians may request deletion of audition materials at any time by contacting:

PROHIBITED ACTIVITIES

 

You may not access or use the Site for any purpose other than that for which we make the Site available.

 

As a user of the Site, you agree not to:

  • Use the Site for unauthorized or commercial purposes

  • Upload harmful software, spam, or disruptive material

  • Attempt to bypass security features

  • Harass, intimidate, or harm other users

  • Impersonate another person

  • Collect information from minors without consent

  • Use the Site to compete with Hitmaker Kids

 

Any violation may result in termination of access.

 

STUDENT CREATIVE WORK & CONTRIBUTIONS

 

Students may create and submit creative work, including:

  • Lyrics

  • Audio recordings

  • Video performances

  • Assignments and class projects

Educational Use Only

Submissions are used for teaching, feedback, and participation purposes only.

​

Ownership

Students retain ownership of their original creative work.

​

Media Release Required for Public Use

Hitmaker Kids will not publicly share student work, names, or likenesses without separate written parental permission through a Media Release Agreement.

 

CONTRIBUTION LICENSE

 

By submitting creative work, you grant Hitmaker Kids a limited, royalty-free license to use the materials internally for educational purposes.

This does not transfer ownership.

 

THIRD-PARTY WEBSITES AND CONTENT

 

The Site may contain links to Third-Party Websites or content.

​

We do not investigate or monitor Third-Party Websites and are not responsible for their content, privacy practices, or policies.

​

Your use of Third-Party Websites is at your own risk.

 

SITE MANAGEMENT

 

We reserve the right to:

  • Monitor the Site for violations

  • Restrict access to protect minors and program integrity

  • Remove inappropriate content

  • Take legal action when necessary

ELECTRONIC COMMUNICATIONS

 

By using the Site, sending emails, or completing forms, you consent to receive electronic communications.

 

You agree that electronic agreements and notices satisfy legal writing requirements.

 

MISCELLANEOUS

 

These Terms constitute the entire agreement between you and Hitmaker Kids.

If any provision is unlawful or unenforceable, the remaining provisions remain valid.

 

GOVERNING LAW

 

These Terms of Use are governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles.
